Terms of Service

These terms apply when you buy or use coaching from 44CLUB Movement Ltd (trading as Forged By 44, "we", "us", "our"). By purchasing, you agree to them. Please read them before you buy. Questions: coach@forgedby44.com.

What we provide

Online fitness and mindset coaching built around your schedule, delivered through our app and messaging, including training, nutrition guidance, habits and mindset support, plus regular check ins and calls with your coach. Coaching is guidance and support. Your results depend on your own effort and consistency, and we cannot and do not guarantee specific outcomes.

Who it is for

You must be at least 18 years old. Before we start, you complete a health questionnaire (PAR-Q). We are qualified Level 3 personal trainers, not medical or clinical professionals. There are some conditions we cannot coach (for example pregnancy or postnatal recovery, an eating disorder, a heart condition, diabetes, or any condition, injury or medication that affects how you exercise or eat). If your answers show that coaching is not appropriate or safe for you, we will not be able to work with you, and we will refund you in full.

Not medical advice

Nothing we provide is medical, dietetic or clinical advice. You should speak to your GP or a relevant specialist before starting any new exercise or nutrition programme, and at any point if you have concerns. You take part in physical activity at your own risk.

Pricing and payment

• £250 per month on a monthly plan, with a four month minimum commitment; or
• £900 paid up front for the four months.

Payments are taken securely by Stripe. By buying the monthly plan you authorise recurring monthly payments until you cancel in line with these terms. Prices include VAT where applicable.

Minimum term and cancellation

The programme has a four month minimum commitment. After that, the monthly plan continues on a rolling monthly basis until you cancel, and you can cancel with fourteen days notice. Payments already made for months delivered are not refundable, and nothing further is owed once you have cancelled and served your notice.

Refunds

Fit refund: if your onboarding shows we are not the right fit for you, or that we cannot safely coach you, we will refund you in full. Beyond this, because coaching is a personalised service that begins straight after purchase, the standard statutory cancellation period may not apply once delivery has started. Your legal rights as a consumer are not affected.

Your responsibilities

• Give us honest, accurate information, including about your health.
• Tell us promptly if your health or circumstances change.
• Follow guidance sensibly and within your own limits, and stop if something hurts.
• Engage with the programme; results depend on your consistency.

Intellectual property

All programmes, plans, resources and content we provide are ours and are for your personal use only. You may not share, resell or distribute them.

Liability

We do not exclude liability for death or personal injury caused by our negligence, or anything else that cannot be excluded by law. Otherwise, to the extent permitted by law, our total liability to you is limited to the amount you have paid us for the programme.

Your data

We handle your personal data, including health data and photos, in line with our Privacy Policy.

Changes

We may update these terms from time to time. The version that applies to you is the one in place when you purchased. The date at the top shows when this was last changed.

Governing law

These terms are governed by the law of England and Wales, and subject to its courts.
